These Terms & Conditions govern your use of the Heart in Himalaya website and your participation in our treks, guided experiences, adventure trips, cycling expeditions, educational programmes and other services.
By making an enquiry, confirming a booking, or participating in an experience organised by Heart in Himalaya, you agree to these Terms & Conditions.
1. About Heart in Himalaya
Heart in Himalaya is an adventure and travel company founded by Shashank Rohilla, offering guided treks, adventure trips, cycling expeditions, outdoor education programmes and related experiences.

2. Our Services
Heart in Himalaya offers outdoor and adventure experiences that may involve trekking, hiking, cycling, road travel, camping, mountain environments and other activities depending on the programme.
The information published on our website is intended to provide a general understanding of each experience. Actual routes, timings, accommodation, transportation and other arrangements may vary depending on weather, local conditions, safety requirements and other circumstances beyond our reasonable control.
3. Enquiries & Bookings
Submitting an enquiry through our website does not by itself constitute a confirmed booking.
A booking becomes confirmed only after the programme, dates, inclusions, pricing and other relevant arrangements have been agreed upon and the required advance payment has been received.
We reserve the right to decline an enquiry or booking where we reasonably believe that a programme may not be suitable for a participant’s requirements, fitness level, experience or safety.
4. Advance & Balance Payment
For bookings where payment terms have been agreed, a 50% advance payment may be required to confirm the booking.
The remaining 50% balance must be paid within the timeframe communicated by Heart in Himalaya during the booking process.
At present, bookings and payments may be arranged directly with Heart in Himalaya rather than through an online payment gateway on the website.
Specific payment instructions, deadlines and applicable charges will be communicated to the participant before the booking is confirmed.
5. Itinerary & Programme Changes
We make reasonable efforts to follow the itinerary published or agreed at the time of booking. However, mountain and adventure travel is subject to conditions that cannot always be predicted.
Routes, schedules, campsites, accommodation, transportation, activities or other arrangements may need to be changed, shortened, extended or cancelled when reasonably necessary because of:
- Weather conditions
- Trail or road conditions
- Natural events
- Government or local authority restrictions
- Safety concerns
- Health or medical emergencies
- Transportation problems
- Conditions at high altitude
- Other circumstances beyond our reasonable control
Where reasonably possible, we will communicate significant changes to participants and make appropriate alternative arrangements.
6. Participant Responsibilities
Participants are expected to:
- Provide accurate information during the booking process
- Follow instructions given by trek leaders, guides and designated staff
- Follow safety procedures and local regulations
- Respect fellow participants, local communities and the natural environment
- Arrive at designated meeting points on time
- Carry the equipment and personal items specified for the programme
- Avoid behaviour that may endanger themselves or others
Heart in Himalaya may ask a participant to leave an activity or programme if their behaviour creates a serious safety concern or puts themselves, staff or other participants at unreasonable risk.
7. Fitness & Medical Information
Adventure activities require an appropriate level of physical fitness.
Participants are responsible for assessing whether they are physically and medically capable of undertaking the selected programme. Participants should inform Heart in Himalaya in advance about any relevant medical condition, injury, medication, allergy or other circumstance that could affect their participation or safety.
We may recommend that a participant seek medical advice before undertaking a particular programme.
Providing medical information does not guarantee that a participant will be accepted onto a particular activity.
8. Adventure & Natural Risks
Trekking, mountaineering, cycling, camping and other outdoor activities involve inherent risks.
These may include, among other things:
- Falls and injuries
- Slips and difficult terrain
- Altitude-related problems
- Extreme or rapidly changing weather
- Cold, heat or dehydration
- Rockfall, landslides or other natural hazards
- Wildlife or insects
- Road and transportation risks
- Limited access to medical facilities
- Delays or changes caused by conditions in remote areas
Participants understand and voluntarily accept the inherent risks associated with the activities they choose to undertake.
9. Safety & Guide Decisions
The safety of participants is a priority throughout our programmes.
Our trek leaders, guides or designated representatives may modify a route, change a schedule, turn back from a particular point, restrict participation in an activity or take other safety-related decisions when conditions require it.
Such decisions may be made based on weather, terrain, participant condition, altitude, local information or any other reasonable safety consideration.
Participants are expected to cooperate with such decisions.
10. Transportation & Third-Party Services
Certain elements of a programme may involve third-party service providers, including local transport operators, accommodation providers, camps, homestays, restaurants or other suppliers.
While we make reasonable efforts to work with reliable providers, their services may be subject to their own terms, availability and operating conditions.
Transportation timings and arrangements may change because of traffic, road conditions, weather, mechanical problems or other circumstances.
11. Accommodation & Meals
Accommodation and meals vary according to the particular programme and will be communicated as part of the inclusions.
In remote mountain areas, facilities may be basic and can differ from those normally available in cities or conventional hotels.
Participants should understand that changes to accommodation or meal arrangements may occasionally be necessary because of availability, weather, local conditions or safety considerations.
12. Personal Belongings
Participants are responsible for their personal belongings, valuables, documents, electronic devices, luggage and equipment throughout the programme.
Heart in Himalaya cannot be held responsible for loss, theft or damage to personal belongings except where such responsibility cannot legally be excluded.
Participants should avoid carrying unnecessary valuables and should take reasonable precautions with their belongings.
13. Photography & Content
Heart in Himalaya or its representatives may photograph or record activities for documentation and promotional purposes.
Where appropriate, we may use photographs or recordings containing participants on our website, social media or other promotional channels.
If you have a specific concern about the use of your image, please inform us.
14. Cancellation & Refunds
Cancellations and refunds are governed by our separate Cancellation & Refund Policy.
The applicable cancellation terms will depend on the programme, timing of cancellation and circumstances involved.
Participants should review the Cancellation & Refund Policy before confirming a booking.
15. Travel & Personal Insurance
Participants are encouraged to obtain appropriate travel and adventure insurance covering the activities they undertake.
Depending on the nature and location of the programme, appropriate insurance may include coverage for medical treatment, accidents, trip interruption, cancellation, evacuation and other relevant risks.
Participants are responsible for understanding the terms and limitations of their own insurance policy.
16. Force Majeure
Heart in Himalaya will not be responsible for failure or delay in providing a programme where this results from circumstances beyond our reasonable control.
These may include severe weather, natural disasters, landslides, road closures, government restrictions, strikes, civil disturbances, epidemics, transportation disruptions, emergencies or other unforeseen events.
Where such circumstances occur, we will make reasonable efforts to communicate with affected participants and determine the safest and most practical course of action.
17. Website Information
We make reasonable efforts to keep the information on our website accurate and current. However, descriptions, photographs, distances, timings, prices, routes and other information may change over time.
Website content should therefore not be treated as a guarantee that a particular condition, view, facility, route or experience will be available during a specific departure.
18. Limitation of Liability
To the extent permitted by applicable law, Heart in Himalaya will not be responsible for loss, injury, delay, expense or inconvenience arising from circumstances beyond our reasonable control or from risks inherent to outdoor and adventure activities.
Nothing in these Terms is intended to exclude or limit any liability that cannot legally be excluded or limited under applicable law.

Heart in Himalaya may update these Terms & Conditions from time to time to reflect changes in our services, booking processes, website or applicable legal requirements.

20. Governing Law
These Terms & Conditions shall be governed by the laws applicable in India.
Any disputes arising in connection with these Terms or our services shall be subject to the jurisdiction of the appropriate courts in India.
